What we expect from you

Important:

BreezeHost is a subsidiary of Limestone Networks, Inc. All services are provided by BreezeHost ("we," "us," "our"), and usage of our services is subject to our Terms of Service and Acceptable Use Policy ("AUP").

By using our services, you acknowledge that BreezeHost is your service provider and agree to comply with the policies outlined below.

Client Responsibility

Clients are responsible for any and all actions performed through their account—whether performed by the account holder or by third parties. If a server or account is compromised, the client remains responsible for all violations of these Terms of Service and BreezeHost's AUP, including SPAM, abuse, and any associated disconnect/reconnect fees.

BreezeHost does not harden servers or provide additional security software beyond the default operating system configuration.

Agreement to These Terms

The following terms constitute a binding agreement between you and BreezeHost, a subsidiary of Limestone Networks, Inc. ("Parent Company"). These Terms govern the use of services provided by BreezeHost (the "Services").

BY USING OUR SERVICES, YOU AGREE TO THESE TERMS, consent to our AUP, and agree that any disputes will be resolved in Dallas County, Texas. All Services are provided "AS IS", without warranties.

We may modify these Terms at any time. Material changes will be communicated via email (if available) and posted on our website. Continued use of the Services after updates constitutes acceptance of the revised Terms.

BreezeHost Responsibilities

BreezeHost will furnish paid-in-advance services subject to full compliance with these Terms and our AUP. We reserve the right to refuse service or deny renewal at our sole discretion.

Service rates may change over time based on hardware availability, market conditions, or other factors. Clients will be notified prior to renewal if pricing changes apply.

Non-Payment & Service Interruption

  • Services interrupted for non-payment may incur a $25 late fee.
  • Data on suspended services is inaccessible until the account is brought current.
  • Accounts suspended for non-payment or chargebacks may have data permanently destroyed after 7 days.
  • BreezeHost is not responsible for data integrity; clients must maintain off-network backups.

Refunds & Chargebacks

  • BreezeHost does not offer refunds for any Services.
  • Prepayments and account credits are non-refundable and non-transferable.
  • Charge disputes must be reported to BreezeHost within 30 days.
  • If a valid charge is reversed via chargeback, the client agrees to pay:
    • The original amount reclaimed
    • A $200 administrative fee

Suspensions

  • If a service is suspended for non-payment, it becomes eligible for termination after 7 days.
  • A $25 termination fee will be applied and must be paid within 15 days to avoid full account suspension.
  • BreezeHost assumes no liability for data on suspended servers.

Cancellations

  • A 5-day notice prior to renewal is required for cancellations or downgrades via support ticket.
  • If notice is not provided in time, the service will still be canceled, but a $25 termination fee will apply.
  • All client data is destroyed immediately upon cancellation.
  • Resellers may cancel within 24 hours after renewal without penalty; afterward, a $25 termination fee applies.

Fraud

  • Fraudulent accounts or related accounts may be immediately terminated.
  • Information may be provided to law enforcement and financial institutions.
  • BreezeHost pursues fraudulent clients to the fullest extent of the law.

Disclaimers of Liability

Services are provided "AS IS, WITH ALL FAULTS, AS AVAILABLE."

BreezeHost and its parent company disclaim all warranties—express or implied.

Your sole remedy for any issue with the Services is to cancel your account.

We are not liable for:

  • Lost profits
  • Lost data
  • Downtime
  • Business interruption
  • Incidental or consequential damages

To the extent permitted by law, total liability is limited to the amount paid during the billing period in which the claim arose.

You agree to indemnify BreezeHost and its parent company against all claims arising from your use or misuse of the Services.

Support

  • BreezeHost provides hardware support only.
  • We do not provide software configuration, debugging, or third-party client support.
  • One (1) complimentary OS reload is permitted per billing cycle; additional reloads cost $50.
  • Unsupported OS installations require approval and may incur a $50 fee.

Managed Services / Add-Ons

  • All managed services (including routine checkups and proactive management) are provided on a best-effort basis and are not covered by any SLA.
  • Tickets requiring over 1 hour of work incur a $30 fee.
  • Once opened, managed service tickets are non-refundable.

Abuse / Spam Policy

BreezeHost may deny outbound mail delivery from servers involved in SPAM or abuse activities. Abuse reports require a client response within 48 hours.

Failure to respond may result in:

  • Filtering or port restrictions
  • Suspension after 7 days
  • Termination after repeated abuse
  • $200 fine for services that cause IP blacklisting

Compromised servers will be handled case-by-case, potentially requiring reinstallation or manual repair (fees may apply).

DMCA Policy

DMCA complaints are handled seriously.

Procedure:

  • 48 hours: Warning + time to resolve
  • 48+ hours: IP disabled & $25 fine
  • 72+ hours: Service suspension
  • 7 days: Service termination + $200 Abuse Charge

Research fees up to $50/hr may apply for valid claims.

Bandwidth Overage Billing

  • Overages are billed at $0.25 per GB.
  • Unpaid overages after 15 days may result in suspension.
  • Bandwidth spikes—regardless of cause—are the client's responsibility.

Payment Verification

Clients may be required to provide identity verification documents, including:

  • Government-issued ID
  • Credit card copy
  • Utility bill
  • Additional documents as required

Publicity

  • BreezeHost does not disclose client information without permission.
  • Anonymous quotes may be used for marketing unless the client opts out.
  • All communications with BreezeHost are confidential.

Electronic Notifications

  • By using our Services, you consent to receive electronic notices.
  • Notices are effective when sent, regardless of receipt.
  • You must maintain a valid email address.

Entire Agreement

These Terms, along with our AUP and posted policies, constitute the full agreement.

If a clause is held invalid, the remainder continues in effect.

Governing Law & Venue

  • These Terms are governed by the laws of Texas.
  • All disputes shall be resolved exclusively in Dallas County, Texas.
  • By agreeing, you waive claims under other jurisdictions and consent to Texas jurisdiction.
