This Acceptable Use Policy ("AUP") governs your use of all services provided by BreezeHost ("we," "us," or "our"). By using our services, you agree to comply with this AUP and remain responsible for all activity occurring under your account—whether performed by you or by any third party accessing your services.

If server security is compromised, the account holder is fully responsible for all consequences, including violations of the AUP, Terms of Service, or applicable law.

1. Purpose of This Policy

The purpose of this AUP is to ensure that BreezeHost maintains a fast, reliable, secure, and legally compliant hosting environment. These guidelines help protect our network, our customers, and the broader Internet community.

2. Customer Responsibility & Liability

2.1 Account Liability

You are responsible for all actions performed using your services, including unauthorized access resulting from weak security practices.

2.2 Server Security

Customers are solely responsible for securing their servers, applications, and data. BreezeHost disclaims liability for customer-managed content, security, or configuration.

3. Network Misuse

Misuse of BreezeHost's public or private network is strictly prohibited. This includes but is not limited to:

  • Interference with network operations
  • Activities that degrade performance for other customers
  • Violations of local, state, federal, or international law
  • Distributing or hosting pornographic content involving exposed genitalia or explicit sexual acts (regardless of context)
  • Forging any TCP/IP headers or email header information
  • Hosting content you do not have legal rights to distribute

All alleged violations are subject to investigation, and BreezeHost may take whatever action it deems necessary—including suspension or termination.

4. Sabotage

Any form of sabotage is strictly prohibited, including improper use of the remote reboot system (e.g., rapid repeated reboots). Accounts engaging in sabotage may be immediately terminated.

5. Private Backbone Network (Private Tunnel)

BreezeHost provides an internal private network for:

  • Server-to-server data transfer
  • Administrative access
  • Console access
  • Internal data retrieval

This network may only be used for legitimate management and operational purposes. Abuse of the private backbone is prohibited.

6. Network Security Requirements

Clients must maintain adequate security on all systems, including firewalls, updates, and access controls. Any costs resulting from a customer's failure to secure their systems—including attacks, resource drain, or abuse reports—are the responsibility of the customer.

7. Monitoring Policy

BreezeHost does not proactively monitor customer content. We review content only when:

  • A complaint is received
  • A law enforcement request is made
  • A violation of this AUP or the Terms of Service is suspected

Content violating law, our AUP, or our Terms may result in suspension or termination of service.

8. Blacklist Policy

If your use of BreezeHost services causes any BreezeHost IP addresses or ranges to become blacklisted, we may:

  • Suspend service
  • Null route or filter the affected IPs
  • Terminate service entirely

Use of BreezeHost services for, by, or in coordination with entities listed in the Spamhaus Register of Known Spam Operations (ROKSO) is strictly prohibited.

9. IP Addresses

  • All IP addresses assigned by BreezeHost remain our property.
  • You are granted usage rights only for the duration of your service.
  • IP addresses may not be transferred to another provider.
  • Customers needing more than 16 additional IPs may be required to provide ARIN justification.

10. IRC, Bittorrent, and P2P

10.1 IRC

IRC use is allowed unless it creates abuse, security issues, or denial-of-service conditions. IRC servers connected to global IRC networks such as EFnet, DALnet, or Undernet are not permitted.

Any IRC software designed to disrupt service (clones, flood scripts, etc.) is prohibited.

10.2 Bittorrent / P2P

P2P and Bittorrent are permitted only for legal content. Distribution of copyrighted or illegal material is strictly prohibited.

11. Law Enforcement and Legal Requests

If required by law, BreezeHost may provide customer information in response to a valid subpoena or court order. We will notify the customer when permissible.

12. Reporting Violations

Third-party violation reports must include:

  • Complainant name and contact information
  • Source IP address involved
  • Description of the alleged violation

This AUP applies to all users of BreezeHost servers, including downstream customers of resellers.

13. Service Refusal & Termination

BreezeHost reserves the right, at its sole discretion, to:

  • Refuse service to any individual or organization
  • Suspend or terminate service at any time, with or without cause
  • Immediately terminate service for AUP violations

14. Changes to This AUP

This AUP may be updated at any time. Continued use of BreezeHost services constitutes acceptance of the most recent version.
